What Happens if I Haven’t Filed Taxes in Years?

People who ask me this have lost sleep over it. They picture agents at the door and a bill they can never pay. The situation is more manageable than the fear, and the worst move is the one most people make: nothing.

The penalties grow, then they stop

Two penalties stack while a return sits unfiled and unpaid, and interest runs on top.

Failure to file 5% of the tax owed per month 25%
Failure to pay 0.5% per month 25%

The failure-to-file penalty maxes out at 25 percent. Filing a late return ends the largest meter running against you.

If the IRS owes you a refund, there is no penalty for filing late. There is a deadline to claim it. Wait more than three years and the refund is gone.

The clock the IRS never starts

On a return you file, the IRS has three years to audit it. On a return you never filed, that clock never starts. No statute of limitations covers an unfiled year. The IRS can come back to it whenever it wants.

The substitute return

If you never file, the IRS can file for you. It is called a substitute return, and it gives you no deductions, no dependents, no business expenses. It shows the income and calculates the highest tax. Filing your own return replaces that with the real, lower number.

You file six years, not twenty

People assume they owe twenty years of returns. The IRS wants the last six years filed to consider you compliant. We confirm the exact years, pull your income records from the IRS, and file them in order.

The options once they are filed

Owing money and being unable to pay it are different problems, and the IRS treats them differently.

  • A monthly payment plan spreads the balance out.
  • First-time penalty relief may erase a chunk of the penalties.
  • An Offer in Compromise settles the debt for less in some cases.

None of these open until you file.
